Claps Artificial Intelligence Inc. Privacy and Terms of Service Agreement
Introduction
Welcome to Claps Artificial Intelligence Inc. ("the Platform"). These Terms and Conditions ("Terms") govern your use of the Platform, which allows audience members ("Users") to video chat with a digital version of a content creator ("Creator"). By using the Platform, you agree to these Terms. If you do not agree with these Terms, please do not use the Platform.
Definitions
- User: The person using the Platform to chat with a Creator's digital clone.
- Creator: The person who uploads their data to create a digital version of themselves and interacts with Users through this clone.
- Platform: The application and services provided by Claps Artificial Intelligence Inc.
- Clone: The digital version of the Creator trained on their content.
- Company: Claps Artificial Intelligence Inc., a Delaware-based company.
Use of the Platform
1. Creation of Digital Clones
- Creators upload data to produce a digital version of themselves ("Clone").
- The Clone is trained on the Creator’s content for interactions with Users.
2. User Interactions
- Users can video chat with the Clone.
- Users can record and share these interactions.
- Users must adhere to community guidelines and refrain from inappropriate behavior.
3. Creator Controls
- Creators can set a fee for Users to chat with their Clone.
- Creators can advertise to Users through their Clone.
- Creators can review chat logs and see who is interacting with their Clone.
4. Platform Controls
- The Platform has the final say on advertisements and their target audience.
- The Platform reserves the right to monitor interactions and remove inappropriate content.
- The Platform can take punitive actions against Users who violate community guidelines.
5. Responsibility and Liability
- Claps Artificial Intelligence Inc. invests in preventing guideline breaches by Clones.
- The Company is not responsible for isolated incidents where a Clone's behavior breaches guidelines.
- Users who behave inappropriately will be disciplined by the Platform.
6. Content Ownership and Usage Rights
- Users and Creators can republish or redistribute only the content they were part of creating within the Platform.
- The Platform can use all data generated by the Platform and its users.
Payment Terms
1. Payments
- Users pay to chat with Creator Clones through credit card or other accepted payment methods.
2. Refunds
- Refunds are available within 7 days if the service was not provided as promised.
3. Disputes
- Contact us within 30 days for any payment issues. We’ll help resolve disputes quickly.
User Registration and Account Security
1. Sign Up
- Users must provide a valid email address and create a password to sign up.
2. Security
- Keep your password safe and don't share it with anyone. If you think someone else knows your password, change it right away.
3. Account Safety
- You’re responsible for all activities on your account. Let us know immediately if you suspect any unauthorized use.
Prohibited Activities
1. No Hate Speech or Harassment
- Respect everyone. Don't post anything offensive, hateful, or harassing.
2. No Illegal Activities
- Don’t use the Platform for anything illegal.
3. No Spamming
- Don't send unsolicited messages or promotions.
Termination of Accounts
1. Termination Rights
- We can close your account if you break the rules.
2. Notice
- We’ll try to notify you before closing your account.
3. Data After Termination
- You won’t be able to access your content after your account is closed.
Dispute Resolution

- Arbitration will take place in Delaware, unless both parties agree to another location.

Disclaimer of Warranties

- The Platform is provided “as is.” We don’t guarantee it will be perfect.

- We don’t promise that the Clone will always behave or speak perfectly.
Limitation of Liability
1. No Responsibility for Losses
- We’re not responsible for any losses or damages from using the Platform.
2. Maximum Liability
- Our maximum liability is limited to the amount you paid us in the last 12 months.
Governing Law

- These Terms are governed by the laws of Delaware.
2. Jurisdiction
- Any legal disputes will be handled in courts located in Delaware.
